ABSTRACT
It is not that India doesn’t have any witness protection-related provisions, it has but these provisions are not serving the purpose. If India comes up a new legislation, then we are not sure whether this law will serve the actual purpose but it is very much sure that the state has to bear huge expenditure.
The authors in this paper have come up with different approach with respect to Witness Protection Laws. The author realizes that our scholars contributed enough literature to come up with new legislation in India. The authors in this paper critically analyze the literature produced till now and give suggestions as to how India should tackle the issues related to witness protection and try to suggest new ways to enhance the justice administration system wholly. The authors restricted their research with respect to different witness protection laws of different countries depending on the legal systems followed by respective countries. The Indian Adversarial System requires a suitable witness protection program in order to tackle issues of hostile witnesses.
