ABSTRACT
Right to vote is an essential pillar of any democracy. It is this right that is guaranteed to the citizens of the country when exercised, decides the elected representative who shall form part of the government. India is proudly known as the biggest democracy in the world and in country like India right to vote is the very essence that furthers the boundaries the democracy. Every citizen who has attained the age of 18 years has the right to vote and this right is interpreted from the constitution of India under articles 19(1)(a) and 326 and Section 62(5) of Representation of People Act,1951. On the other hand, the prisoners are deprived the right to vote. It is in this context this paper shall analyses the right of prisoners under Indian constitution to exercise their right to vote and whether the restriction by the Supreme Court barring the prisoners from exercising their right vote is reasonable and this study shall be made through a comparative study of prisoners’ right to vote in other countries. This study is based on the doctrinal method of research. shall made through doctrinal method of research.
