ABSTRACT
This research article examines the legal as well as the social implications of underage driving in India, with a primary focus on the victime protection and compensation. Using Pune Porsche Case as a primary and a relevant example, this study explores the gaps in the legal framework and the enforcement of the existing laws of India. Research questions include: 1. How effective are the current laws in preventing underage driving in India? 2. What are legal consequences of the victims and their families and How does socioeconomic status influence the legal outcomes in underage driving cases? The hypothesis posists that despite stringent laws, enforcement of such laws is inconsistent leading to inadequate victim protection and compensation.
The research findings for this article reveal the significant lapses in the legal enforcement of such laws, especially minors from the affluent backgrounds are involved. The Pune Porsche case highlighted the failure of the Indian legal system to hold minors and their guardians or parents accountable for their mishaps, resulting in huge public outcry/outrage. It also showed the attempts of the parents of the 17 year old teenager to manipulate the legal procedures, thus emphasizing the need for stricter enforcement and accountability.
The research underscores the need for a better comprehensive strategies involving legal, educational and community initiatives to address the issue efficiently and effectively. Recommendations include stricter enforcement of the existing laws in India, public awareness campaigns and the technological solution to prevent underage driving. The devastating results of the incidents like Pune Porsche Case highlighted the urgent need for robust measures to prevent underage driving and ensure justice for the victims and their families.
