ABSTRACT


This comprehensive exploration delves into the multifaceted layers of sexual harassment, dissecting societal norms, legal frameworks, and cultural attitudes that perpetuate this pervasive issue. Focused primarily on the Indian context, the article navigates through the definitions, legal implications, and cultural nuances surrounding sexual harassment, shedding light on its profound impact on victims, particularly women. Key legislative amendments, such as Section 354A and the subsequent inclusion of Section 354B in the Indian Penal Code, mark progress in addressing offenses, including assaults with the intent to disrobe. Landmark cases, such as the Mathura and Bhanwari Devi cases, underscore the challenges faced by victims in their pursuit of justice. The Vishaka judgment emphasizes workplace safety, highlighting violations of women's fundamental rights. The article also explores the broader spectrum of sexual harassment, encompassing verbal, non-verbal, and physical forms. While legal frameworks evolve, societal prejudices persist, necessitating a continuous reassessment of laws and cultural attitudes. Drawing parallels with the EEOC guidelines, the article advocates for holistic legislation to address sexual harassment and workplace harassment collectively.
