Unraveling The Tapestry Of Community Mediation In India

ABSTRACT


Historically, the practice of community mediation has been an integral part of dispute resolution in rural India through the Panchayati Raj system, but it has gained legitimacy with the introduction of the Mediation Bill, 2023. India is a land of myriad cultures and is rich in diversity. Beneath this cultural mosaic, lies a complex web of disputes seeking resolution. Community mediation serves as a beacon of hope since conflicts are resolved peacefully and amicably, following a procedure conducive to the parties. The study examines India's historical and contemporary mediation as a viable alternate dispute resolution mechanism. Subsequently, the paper delves into assessing the role of community mediation in daily life. Further, it draws inspiration from the remarkable achievements of Singapore in this field. The ultimate objective is to ascertain how community mediation operates in dynamic environments considering the diverse atmosphere in each of these settings.
