Understanding Federalism: A Comparative Study Between USA, UK, And India

Jipson Joseph, LLM, CHRIST (Deemed to be University), Bangalore

ABSTRACT

Federalism originated in the modern world with the formation of the democratic union in the United States of America. From that moment onwards there were many federal systems of government in the world. Basing on the model given by the American system there were analyses and criticisms on different federal systems. India, which is the largest democracy of the world, also affirms the federal structure. But there are some criticisms about its federal character. Though mostly considered as unitary there are some apprehensions on the federal character of United Kingdom also. A comparative study between USA, UK, and India will enlarge the horizons of federalism. It also will be helpful in evaluating the concept from a critical point of view.

Keywords: federalism, unitary, division of powers, supremacy of the constitution, double citizenship, accountability, liability, independent judiciary.
