INTRODUCTION
India is one of the most culturally, historically, and religiously diverse countries in the world. We, the people of India, and our Constitution are to guarantee fundamental rights to all citizens. It provides equal opportunities for everybody to flourish and reach their full potential; regardless of religion, everyone has equal rights without discrimination based on gender. However, transgender is not a new concept to India recognized in the ancient history of India. Transgender community which actual faces so much discrimination by calling different names like hijras, kinnar etc.
Gender identity is regarded as one of the most important characteristics of human life. In general, an individual's gender at birth becomes a social and legal fact from that point forward. However, comparatively few people have problems because of having been born with whatever gender is assigned to them. Some people believe that the sex given at birth undermines their gender identity or the gender they feel within. These are referred to as "transgender" individuals. There has been a longstanding debate among people concerning transgender persons. They grow breathless in the midst of a conflict between men and women. They have been fighting for their fundamental rights as human beings. However, the society, as well as the political system, has been keeping a blind eye towards them.
