ABSTRACT


This paper examines Chapter 31 of the Criminal Procedure Code (CrPC) in India, which outlines the legal framework for transferring criminal cases from one court to another. The paper argues that transferring cases is crucial for ensuring fair trials and addressing backlogs in the justice system. It details six types of transfers authorized by the CrPC, ranging from the Supreme Court's power to transfer cases between states to the power of magistrates to withdraw cases from subordinate courts. Through legal analysis and case studies, the paper aims to provide a comprehensive understanding of the provisions and procedures governing case transfers in the Indian criminal justice system.
