Trademark Infringement And Cybersquatting In Cyberspace - A Conceptual Analysis

ABSTRACT


In this developing digital age, intellectual property rights have become a critical act which is required for the preservation of all types of intellectual property that are made available in the digital realm or public domain. In light of the present date pertaining to the growing issue of trademark infringement in the digital domain, there has been a heated discussion about intellectual property having a strong framework to combat digital trademark infringement, sometimes known as "cyber-squatting". Trademark infringement in online has grown increasingly common, causing issues forenterprises and intellectual property rights holders.


Cyber – squatting has become a new challenge to digital trademark where the digital marketing has acquired a main platform for all sort of businesses to come and advertise their products. Cybersquatting infringe the trademark and hence prevent the trademark owners from fully utilising and controlling their brand name and reputation on the internet, because the cyber-squatter can use the domain to divert traffic, show advertisements, or sell the domain back to the trademark owner. They used this strategy to extract money from the trademark owner by forcing them to acquire their domain name. The issue of trademark infringement in online has grown increasingly common, causing issues for enterprises and intellectual property rights holders.


This research paper aims to delve into the complicated topic of trademark infringement in cyberspace, investigating the legal frameworks, challenges faced by trademark owners, and viable solutions for protecting valuable intellectual property in the digital environment.
