The Uniform Civil Code Debate

ABSTRACT


A Uniform Civil Code (UCC) is a proposed set of laws that would be applicable to all citizens in India irrespective of their religious affiliations. The UCC is strictly a civil code that deals primarily with personal laws such as marriage, divorce, custody, adoption, and inheritance. Political parties and individual politicians have battled for the UCC over the years. the Law Commission of India released a consultation paper on “Uniform Civil Code” which attempts to redefine the concept of rights and responsibilities. However, it constitutes neither a starting point for such much needed dialogue nor is it a platform for a consensus to emerge for the future. While the debate over Uniform Civil Code (UCC) refuses to go away, issues seem to be more polarized than before on gender equality, rights of children, definitions of marriage and family, freedom of religion, personal laws and so on.
