The Role Of Patent In An AI Driven World

ABSTRACT


Artificial Intelligence has been one of the disruptive technology of the present day time. The Artificial Intelligence in the present day time has become an industrial revolution, Artificial Intelligence has decreased the cost by increasing the accuracy, by increasing sustenance, by simplifying complexity, altogether AI has improved the lives of many and their working conditions. AI is nothing but the intelligence that a machine carries and it enables sustainable development and pushes the boundaries and new boundaries require new approaches to IP protection. AI is nothing but a mix of what a human brain thinks and sees and how well a computer system performs it. However, AI is all about inventions and innovations, a person who has a keen interest in inventions for him AI as a tool is a must. With the developing and advancing technology AI has not just solved the problem that a lot of human being face but has added more meaning to their intelligence by reducing their burden and improving efficiency. Humans since time immemorial have tried their level best in creating things that would ease their lives and AI is that tool which clearly has been a substitute to the human brain.


Talking of the legal aspect here, the most important step in the Patent process is the inventive step and the recent advances and developments that AI has shown is commendable and a lot of inventors using AI as a tool in their invention process have been looking for patenting the same. The paper would cover all such intricacies of how the patent law is concerned about AI being granted the patent and its role. However, this Research paper intends to bring to light and analyse the doctrinal legal research that has been done in exploring certain aspects of the IP law particularly concerning the Patent law and its processes. It shall cover the barriers that might occur in Patenting the Artificial Intelligence, the developments made in AI and the challenges that IPR law may face, it shall concern the Patentability criteria in different countries and certain recent upcoming trends by the European Patent office.
