The Right To Privacy As A Fundamental Right – A Critical Examination With Respect To The Case Of K.S. Puttaswamy Vs Union Of India

ABSTRACT

Protecting ‘Life and personal liberty’ of an individual is in the core of the Constitution and therefore has to be given widest connotation. There are so many rights which are not expressly provided in the Constitution but are implicit and are essential to make a person’s life a dignified life. Supreme Court dives deep into the Constitution and brings out these Fundamental Rights through judicial interpretation. The transformational goal of the Constitution is the betterment of the individual’s life and the courts plays an important role in furthering this transformational goal by applying its judicial mind. One such revolutionary judgement is the case of K.S. Puttaswamy vs Union of India where the Apex Court irrevocably recognized that right to privacy is one of the dimensions of the Fundamental Rights under Article 21 of the Constitution.
