The OTT Industry & The Ineptitude Of Copyright Law

ABSTRACT

Due to COVID-19, people were forced to find means of entertainment within the confines of their home. This gave an increased rise in the use of over-the- top platforms. Over-the-top or OTT networks are networks that deliver services or applications over the internet. OTT providers typically deliver their content to customers on top of network infrastructure that is owned and maintained by internet service providers.

According to EY, the OTT industry in India is estimated to grow at 17% over 2021 and touch a revenue of INR 33,800 crore by 2022. It cannot be doubted how influential and widespread OTT media has become.

Despite the convenience of OTT platforms, many wish to view the content available on such networks without having to pay for the same. This is an infringement of Intellectual Property laws including copyright. This paper aims to address the challenges OTT networks face with respect to protecting their creations from copyright infringement. Furthermore, it analyses the existing legal structure and establishes the changes that must be made to it in order to effectively protect OTT material.
