The Leniency Paradigm Shift: Contemporary Competition Law Issues

ABSTRACT


This paper looks at how companies engage in cartel activity and how it affects customers and competition, and how different punishment systems exist in the US, EU, and India. It highlights the necessity for more uniform enforcement as well as the “Competition Commission of India's” very recent formation. As a result of the analysis's discrepancies in penalty computations and the policy's poor application, it is necessary to provide precise rules in order to increase deterrent and promote fair competition. In addition, it presents the "Leniency Plus" idea in India and talks about the advantages and disadvantages of it. The study emphasises how crucial it is for India's competition law environment to have both improved leniency policies and a well-defined punishment system.
