The Legal Personality Of Conjoined Twins: An Analysis

ABSTRACT

The paper aims to analyse and highlight the legal identity of the medical marvel of conjoined twinsin society by evaluating various theories with regard to the same. Furthermore, the legal considerations involved with regard to the allocation of rights and duties to such twins, particularly revolving around the right to life and personal liberty are also dealt with. In addition to this, the paper provides suggestions and highlights arguments as to whether the twins are to be considered a singular legal entity or distinct identities with separate rights and the ramifications with regard to the practical applicability and consequences of the same. Further, with the aid of landmark judicial interpretation revolving around the assignment of rights to conjoined twins, the paper analyses the jurisprudence revolving around legal identity. Finally, the paper deals with the moral,ethical, and jurisprudential aspects of separation surgeries and the issues that arise regarding the same within the sphere of the assignment of legal personality.
