The Legal Landscape Of Genetic Privacy In India: A Critical Analysis

ABSTRACT


Genetic Privacy is concept of protecting individual’s genetical information or details from other persons. The protection of an individual's genetic information against unauthorised access, use, or disclosure is referred to as genetic privacy. This encompasses securing genetic testing, genomic sequencing, and information regarding genetic predispositions, as well as the ethical, legal, and societal considerations that go along with it. The Article 21 of Indian Constitution is often interpreted and included right to privacy of an individual by the court. The term privacy has its origin from ancient period. Alan Westin has contributed lot to the filed of privacy. Technological advancements is the main key factor for the violation of genetic privacy. We explore the roles of Indian courts in protecting the genetic privacy in India. In this abstract, we explore the ethical and legal aspects of genetic privacy, emphasizing the role of legislation such as the Genetic Information Nondiscrimination Act (GINA) in the United States. In conclusion, genetic privacy is not merely a matter of safeguarding data; it's a fundamental right that empowers individuals to make informed decisions about their health and genetics while ensuring that their sensitive information remains confidential and protected.
