The Legal Implications Of Artificial Intelligence (AI) In Cybersecurity And Data Privacy: Guardian Angel Or Algorithmic Overreach?

Atul Chandra, Law Graduate from Dr. Ram Manohar Lohia National Law University, Lucknow

ABSTRACT

The paper explores the complex legal issues surrounding AI’s employment in cybersecurity and data privacy, where reliance on big data is a major concern. Thus, it tries to figure out what the existing legal frameworks are and their limitations about AI advancements. It uses case studies of courts grappling with AI and privacy as an example of why there must be clear laws on this issue. Examples such as data, case studies together with public apprehensions regarding artificial intelligence and data protection demonstrate both the advantages and disadvantages of using AI in cybersecurity.

This research provides insight into the legal consequences of algorithm overreach including possible due process violations and algorithmic biases. This will help highlight some of the problems at stake when holding developers and users accountable for AI systems that should be transparent and explainable.

Ultimately, the paper offers guidelines for a well-rounded legal regime governing AI in cybersecurity. Such principles include promoting global partnerships and adopting definite positions for law enforcement agencies as well as demanding human authority along with responsible AI development. The study looks at these issues to make some contribution to the future wherein artificial intelligence can bolster cyber security without violating privacy rights.
