Sneha Priya, CHRIST (Deemed to be University), Delhi-NCR Campus

ABSTRACT

In this study the legislative framework governing gender-affirming access to care varies significantly between nations, and gender dysphoria among minors is a complicated and delicate subject. This study aims to clarify the legal implications of gender reassignment surgery for children and investigate how these ramifications impact access, consent, mental health outcomes, and human rights. The study focuses on age restrictions, the need for parental consent, informed consent procedures, and the function of mental health evaluations in determining gender-affirming access to care. It also examines how laws balance minors' rights and their parents' or guardians' obligations. The study also examines how international human rights conventions and legal precedents affect the legal system in various geographical areas. It explores the moral issues raised by these evaluations and how they might affect outcomes for mental health and access. This study aims to provide a thorough understanding of the legal complications surrounding gender reassignment surgery for minors by a combination of legal analysis, comparative case studies, and interviews with specialists in the field.
