ABSTRACT
This paper delves into the legal aspects of asylum and refugee protection, elucidating the nuanced frameworks that govern these critical areas. The internationally recognised fundamental right of asylum refers to the right to seek shelter in a host nation because of legitimate fears of persecution. Protecting the rights and welfare of those who meet the requirements for refugee status includes avoiding their forced return to dangerous circumstances. This is known as refugee protection. In India, these matters are resolved through specialised laws like the Foreigners Act, 1946, and constitutional provisions, particularly those pertaining to fundamental rights. This paper examines the legal complexities, explores gaps, and highlights the need for a comprehensive legal framework.
