Nandani Rathore, LLM, National Law Institute University, Bhopal

ABSTRACT

This study investigates the intersection of competition law and data protection in E-commerce, focusing on the dominance of large companies and the risks of data breaches. It explores the conceptual framework of abuse of dominance and the relationship between competition and data protection regulations, highlighting critical issues and regulatory challenges. By examining cases of data breaches and relevant legislative measures, the research identifies overlapping areas and potential conflicts between the two legal frameworks. It also examines the role of judicial activism in shaping enforcement and interpretation. The study concludes with suggestions to enhance regulatory synergy, ensure robust data protection, and curb abusive practices, contributing to the harmonization of competition and data protection laws for a safer, more competitive digital marketplace.
