ABSTRACT
The under-trial prisoner population has been constantly on the rise in India, the living conditions at the prison for the prisoners are generally not in accordance with the law. The increasing prisoner population has a profound effect on the living and on the socio-economic conditions of the prisoner. When an individual gets the tag of the prisoner, the society labels the said individual with a tag. Thus, the research article shall also discuss in detail about the effects of the labeling theory on the under-trail prisoners along with the strain theory in order to understand the effects of the same on the behavioural aspect of an under-trial prisoner, as to how does the under-trial prisoner deem to see the society upon social re-integration. This research article shall also discuss as to how this directly impacts on the conditions of the prisoner from a criminological point of view, this would lead to the broad audience as well as the policy-makers to question as to whether there is a dire need for creating such stringent laws that result in the over-crowding of the prisons.
