The Global Justice Problem Of Climate Change: The Role Of Hyper Nationalism In It

Pubali Dutta, LL.M., West Bengal National University of Juridical Sciences (WBNUJS)

ABSTRACT

The problem of climate change is not a new one. In 1987, even though Montreal Protocol did not mention anything about climate change, it ensured that signatory countries do not create any substance which may damage the ozone layer, for example CFCs. It can be considered as the first step towards prevention of climate change. Before, I go into the need for globalization, it is important to understand the reasons behind the need for prevention of climate change. For the last few years the temperature of earth is rising rapidly and many individuals are already sufferers of the heat wave. Even though many seem to think that this problem can be solved by installing air- conditioning machine in their homes and offices, sadly the problem of climate change is a lot bigger than it seems. While the temperature of earth is rising it affects not only human beings but also our environment deeply. To preserve our ecology and to protect our flora and fauna, it is the need of the hour to prevent climate change. Changing climate begets droughts and floods, it destroys ecologies and ultimately it can destroy the earth forever.

Now, the problem of climate change cannot be confined within the territorial boundaries of any State. A State may contribute a little or a lot in environmental pollution but the dangerous effects of climate change will not care about territorial boundaries and every country rather every individual will become a victim of climate change.

From UN Framework Convention on Climate Change (UNFCCC), 1992, Kyoto Protocol (2005), Paris Agreement, 2015 to COP26 (2021), we have a lot of international norms to control climate change but the lack of implementation of these norms and due to various other reasons rapid globalization is needed where the people of earth have to adopt global laws strictly to save the earth, especially to save themselves and the future generation.
