The Fundamental Right Of Speech And Expression And Its Foundations And Impact On Today’s World

ABSTRACT

The United States Bill of Rights served as a major model for India's creation of Fundamental Rights. These rights are protected by the constitution because it is believed that they are necessary for each person's personality to grow and for the preservation of human dignity. Allowing all citizens to engage in the political and social activities of the nation is a fundamental component of a functional democracy. In a strong democracy, there is plenty of room for free speech, opinion, and expression in all of its forms. This paper seeks to highlight how Freedom of Speech and Expression is subject to violations, whether it be on online platforms or physically and there have been curtailments concerning this Right on part of many Higher Authorities in India. It looks at various landmark judgements that highlight the said fundamental right while also looking at various new age perspectives of the same. There is no doubt in the fact that this important Freedom has been the victim of suppression various times. It can be said that not having the Freedom of Speech and Expression leads to a whole new spectrum of the extinction of our Human Rights.
