The Evolving Workplace: Navigating Indian Labour Laws In The Age Of Work-From-Home

ABSTRACT


Being a socially evolving field, Law and its legal studies need amendments to make it relevant to evolving times. However, “questioning” needs to be done to decode the vagueness in the existing law system which brings out its existing flaws. Accordingly, this research paper aims to question regarding compatibility of existing Indian Labour and Employment laws with the “Work from Home” or “Remote Working” or “Home working” mode of working which gained relevance during the nationwide lockdown amidst the COVID-19 pandemic. Apart from shining light upon current Indian Labour and Employment laws, the paper discusses amendments in Employment taken place in other countries to make it compatible with “Work from Home” mode. Later, this paper makes suggestions regarding what key legal aspects should be considered as a priority while making amendments to Indian labour law after considering the requirements of the “Work from home” mode of working.
