The Ethics And Legality Of Using AI Algorithms In Criminal Justice

Mr Sidharth Puri, B.A. L.L.B.(Hons.), Himachal Pradesh National Law University, Shimla

ABSTRACT

With its potential to forecast recidivism rates and set bond amounts, artificial intelligence (AI) has grown in strength as a tool in the criminal justice system. However, there are important moral and legal concerns around accountability, justice, transparency, and privacy that are brought up by the usage of AI. Because AI algorithms have the potential to reinforce systemic biases found in the data they are trained on, bias and discrimination are serious issues. Because the intricacy of AI algorithms might make their decision-making processes difficult to understand, transparency is also crucial. Establishing legal responsibility frameworks is necessary to hold institutions and creators responsible for biased results. Furthermore, AI should be used to supplement human judgment rather than to replace it, making sure that moral and ethical issues are taken into account when making decisions. AI can improve the criminal justice system while maintaining justice and equity by tackling these problems.

Keywords: AI algorithms, criminal justice, bias, discrimination, transparency, accountability, legal liability, human judgment, ethical implications, and fairness.
