The Effectiveness Of International Trade Agreements In Addressing Anti-Competitive Practices Of State-Owned Enterprises In Emerging Economies

1. ABSTRACT


State-owned enterprises (SOEs) are government-owned entities that often operate with motives beyond profit maximization, such as fulfilling governmental or political objectives. This can lead to market disruptions and competitive imbalances. To address these issues, international frameworks like GATT and various Free Trade Agreements (FTAs) have been established to regulate SOEs. This project explores the interplay between competition law and FTAs in regulating SOEs, focusing on the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) as a model. It discusses the challenges posed by SOEs, the regulatory frameworks in place, and suggests ways to enhance coordination between competition laws and FTAs for more effective regulation.
