The Difference In Minimum Age Requirements For A Valid Hindu Marriage For Men And Women

ABSTRACT

For a valid marriage to take place under Hindu Personal Law, certain conditions are to be met. One such condition is that the male must be above 21 years of age and the female must be above 18 years of age. In a country which professes and prescribes equality within its constitution, such a difference in minimum age requirements for a valid Hindu marriage may strike one as odd. This paper aims at understanding the issue in a manner that is holistic. By looking into the possible rationale behind the same, considering diverse personal laws, identifying the far reaching effects of the problem at hand, acknowledging the status quo and suggesting remedial actions, this paper seeks to engage with the issue in depth.
