The Critical Challenges Of India’s Cybersecurity Laws And Regulations

ABSTRACT

Cyber is a relatively new, virtual arena where excruciating communication, business, banking, criminal, and military operations are currently taking place. These actions have consequences that national legal systems and the international legal order have never before confronted. These defining features of Cyberspace and capabilities raise a variety of substantial legal and security challenges and dilemmas. Legally governing cyberspace is one of the greatest issues facing modern states. Existing legal rules and standards' application in cyberspace is the subject of extensive dispute in a wide range of legal realms. At the same time, attempts are being made to establish new cyberspace-specific rules where old rules cannot be applied correctly. For some matters, opinions are mixed, and some questions remain unanswered. This study provides an analysis of the legal features of cyberspace's functioning and a review of the process of normative regulation in this environment, with a particular emphasis on Data Protection and Cybersecurity . The research concentrates on the legal concepts that, in the context of this article, are most affected by the repercussions of cyber activities, and thus represents the most technological leap in terms of establishing a legal framework that forms the basis for cyberspace security.
