The Concept Of Marriage And Divorce Under Hindu Law: An In-Depth Analysis

ABSTRACT

In this paper, the author has discussed about the Hindu marriage and the Divorce under the Hindu Marriage Act 1955. Hindu culture and tradition place a lot of emphasis on marriage and divorce. Marriage is regarded as a spiritual union of two people that not only brings them together but also their families. All Hindus, including Sikhs, Jains, and Buddhists who are not subject to their own distinct laws, are covered by the act.

However, if a marriage becomes irreparable, Hinduism provides the option of divorce. Generally, Hindu marriage and divorce play an important role in Hindu society and are controlled by laws and traditions that are meant to protect the interests of both parties.

This paper outlines the requirements for a legal Hindu marriage and the grounds which are essential to seek for divorce in the court of law.

The latest judgments related to hindu law and analysis on divorce rate in recent years is also presented via this research paper.
