The Balance Between Data Privacy And Advancement Of Virtual Reality: The Exigency Of Legal Norms Behind It

Arpit Bansal, Jindal Global Law School

ABSTRACT

The swift advancement of virtual reality (VR) technology has resulted in a pressing necessity to tackle the delicate balance between safeguarding data privacy and advancing immersive digital experiences. The increasing integration of virtual reality (VR) applications and devices into our daily lives has raised issues over the gathering, storing, and use of personal data. This abstract examines the critical need for all-encompassing legal standards to protect people's privacy in the VR environment. Virtual reality presents serious data privacy challenges because of its enormous potential in industries including gaming, education, healthcare, and communication. The abstract explores the complex aspects of this problem, discussing the risks associated with biometric data disclosure, the invasiveness of VR data collecting, and the possibility of data abuse by both bad actors and companies.

It is evident from this that the complex issues raised by virtual reality cannot be adequately addressed by the current data privacy regulations. Thus, the importance of developing strong and flexible legislative frameworks that strike a balance between innovation and individual privacy is emphasised in this abstract. These standards should specify the parameters for data collection and use, as well as require openness, user consent, and strong enforcement measures. To sum up, the development of virtual reality technology needs to be balanced with the critical need to safeguard individuals' rights to their personal data. Establishing comprehensive legal norms for the VR landscape is essential to ensure a responsible and ethical evolution of this transformative technology.
