The Admissibility And Evidentiary Value Of Dying Statement Under Indian Evidence Act, 1872: A Bird’s Eye View

ABSTRACT
A dying declaration is the statement of a person who has died explaining the cause or circumstances of his death. His statement will be relevant in every case or proceeding in which the cause of that person’s death comes into question. Though dying declaration is necessarily a piece of hearsay evidence generally having no relevance still it is admissible in evidence as an exception to the general rule due to the famous maxim nemo moriturus praesumitur mentiri which means no one meets his Maker with a lie in his mouth.
