Testing The Validity Of The Agency As A “Contract” Instead Of An Agreement

ABSTRACT

Agency is an agreement between two parties, namely the principal and the agent, where the agent agrees to help the principal enter into a contract with a third party. We see such agreements all around us. For example, when we apply for a life insurance, the insurance agent helps us enter into a contract with the Insurance Agency or when one applies for any university, the interviewer becomes an agent of the university and takes the interview of the person and helps him take admission. Such is the importance of the concept of Agency, and its parties defined under Section 182 of the Indian Contract Act, 1872. This research paper aims to analyze the concepts given in Section 182-239 and help the reader understand an Agency agreement better.
