Sustainable Development: A New Approach Towards Mitigation Of The Conflict Between Development And Environment Through The Lens Of Indian Judiciary

ABSTRACT
Sustainable development is not a new concept for the world, it has a long existence in society, but it is the contribution of Brundtland Commission in bringing it as a solution to environmental problems. After the period of 1960s when industrialization and urbanization became the most important component for attaining economic growth and development, it resulted in degradation of the environment and its natural resources and it also became apparent that the development and protection of the environment cannot go hand-in-hand. Both have an inverse relationship but the solution of this conflict has been brought by the Brundtland Commission as sustainable Development which required a balanced and harmonious relationship between these two i.e., environment and Development. This has been also emphasized by the Indian judiciary while dealing with the conflict of environmental problems. This article is an attempt to fill the gap between environment and development through highlighting the crucial role of Indian judiciary in proliferation of the concept of sustainable development.
