ABSTRACT

This research paper examines the complex interplay between statutory interpretation and judicial activism in India's legal landscape. With an evolving judiciary that embraces an active role in shaping policy and social change, it becomes imperative to strike the right balance between judicial activism and the traditional principles of statutory interpretation. This paper explores the challenges and opportunities presented by judicial activism in India and discusses the need for a nuanced approach to statutory interpretation that respects the legislative intent while accommodating judicial intervention. By analysing key cases and scholarly opinions, this research paper aims to shed light on the delicate equilibrium required for effective statutory interpretation in the age of judicial activism in India.
