Socio-Legal Implications Of Surrogacy In India

ABSTRACT

Modern era is a legal era where every relationship has been defined by law. Law regulates thesociety so that the peace and harmony between different sections of society should bemaintained and the society would develop with development of every section of society. With the entry of law in every sphere of human life now every relation is defined from the angle of law. That why the concept of surrogacy is also to be seen from the mirror of law. It is need of hour that surrogacy should be seen from the prism of various sections of society which are directly or indirectly effected by it. From the prism of surrogate mother, surrogate child, commissioning couples, ART clinics and banks, government, various pressure groups and most importantly from the angle of law of the land. Surrogacy is the major practice of assisted human generation for individuals who cannot, or choose not, to procreate in the conventional manner. The paper mentions various socio-legal implication that are prevalent in surrogacy in India. The paper concludes with some suggestions and recommendations on the problems that are there with surrogacy.
