Social Legal Study On Unmarried Couple Rights: A Critical Study

ABSTRACT


Love in India is clearly not an 'internal affair'. Everyone from your neighbours, parents, schoolteachers, office colleagues, street viewers, and your government seems to be contributing to it. Have you ever gone out with your partner and been stared at as if you’d done something wrong? You may have wondered how difficult it is for unmarried couples to spend time in public places, check in at hotels together, travel together, staying together in a Live-in relationship, so where does the problem arise? Is doing all this go against the law or you are subject to mental harassment by the society which considers it against their culture/tradition or by the public authorities who take the benefit of you being unaware of your rights. In India, one of the most serious issues is that individuals are too preoccupied with assisting others to take care of their affairs. This research focuses on identifying the legal rights of unmarried couples, legalization of live-in relationships, the problem of honour killing, various issues faced by the unmarried couples, Solutions to their problems so that they should have clarity over their rights and boundaries, which protects them from being mentally harassed and physically assaulted by the society and public authorities. Here unmarried couples are considered to be those who have attained the age of majority. There have been many incidents, cases, and Precedents which eventually highlight the issues and define the rights so based on the data available various conclusions have been formed in this paper pertaining to the issues.
