ABSTRACT
This article exposes the oppressive misuse of sedition laws in India, which have a detrimental impact on freedom of expression. It delves into the historical context of these laws, introduced by the British to suppress Indian nationalists, and highlights their continuation in independent India. The article discusses the surge in sedition charges, specifically targeting government critics, and critiques the judicial opinion that upholds the constitutionality of the law. It presents statistics and real-life cases to illustrate the arbitrary and excessive use of sedition charges. The article concludes by advocating for the repeal or reform of the sedition law, emphasizing the importance of safeguarding citizens' right to dissent while considering national security concerns.
