Scrutinizing The Governor's Power To Withhold Assent: An Indefinite Veto Under Article 200?

ABSTRACT
This paper examines the multifaceted role of the Governor in India's legislative process, specifically focusing on their power regarding assent to Bills passed by the State Legislature. While Article 200 of the Constitution empowers the Governor with various options – assent, withholding assent, returning for reconsideration, or reserving for Presidential review – their ultimate action plays a critical role in ensuring effective legislation. This paper argues that the Governor's power to withhold assent requires scrutiny. The lack of a defined timeframe for processing withheld Bills creates a potential for misuse and legislative deadlock. Establishing a reasonable timeframe would ensure a balance between the Governor's role as a check on the Legislature and the need for timely enactment of legislation.
