Santhara Under The Ambit Of Essential Religious Practices And Its Consonance With Right To Die

ABSTRACT

In this Research Paper the Practice of Santhara is being understood through the understanding of the same by religious tenets found in Jainism. The judicial creativity is highlighted through a series of judgements which defined the essential religious practices test. The Practice of Passive Euthanasia is discussed and the legality of both practices is contemplated by differentiating the two from the act of suicide which is illegal in the Indian subcontinent.
