Rule Of Law, Dicey’s Concept And Criticism: Critical Analysis

Avantika Rawat, University of Petroleum and Energy Studies, Dehradun

ABSTRACT

The phrase "Rule of Law" is taken from the French expression "La Principe de Legalite," which describes a government based on moral and legal standards as opposed to ruler's whims. The rule of law in the UK has, historically speaking, been intimately associated with A.V. Dicey. In his work Introduction to the Study of the Law of the Constitution, Dicey describes his understanding of the rule of law. The idea of Professor A. V. Dicey, which was so agreeable to nineteenth-century individualism, has come under scrutiny in more recent years. Academicians and theorists have criticised A.V. Dicey's results and assertions.
