RTI Act, 2005 And Digital Personal Protection Data Law: Need To Harmonize Competing Interests

ABSTRACT


Digital Personal Data Protection Act- 2023 was notified in official gazette on August 11, 2023 after it got Presidential assent. The Bill was passed by both the Houses of Parliament earlier. The claimed objective of data protection law is to provide for the processing of digital personal data in a manner that recognizes both the rights of individuals to protect their personal data and the need to process such personal data for lawful purposes. The new law has, however, has attracted considerable criticism from certain quarters mainly on the ground that it has potential to weaken further the RTI Act-2005 by severely restricting its scope. There are allegations that data protection law has given wide discretionary powers to government in rulemaking and thus, it will potentially place impediments and restrictions on public disclosures. The article takes a critical view of both the legislations with regard to amended clauses of RTI Act and it’s likely impact on good governance.
