Role Of Guarantees In Supply Chain Finance: Analysing The Legal Implications Of Cross- Border Transactions

ABSTRACT


This research article investigates the multifarious challenges dealing with the mechanics of supply chain finance and the guarantee structure involve in the system. The article covers the challenges surrounding guarantees in cross- border supply chain finance(CBSCF), covering an increasingly complex global landscape. It examines the “guarantees” by diverse jurisdictional issues and enforceability across various legal systems, arises out of international trade and how crucial is to ensure the mitigating risks in international trade. The article analysis the evolving trend of financial technology involving the legality in finance chain management and smart contracts assuring the guarantee structures arising from their implementation.


A core focus is placed on identifying the effect of trade wars, geopolitical tensions and sanctions on businesses and markets to ensure the reliability and fairness of guarantees, focusing on risk management strategies. The study explores the intersection and governance of supply chain monetary policy with SCF guarantees, making a centralised bank intervention system and fluctuations that sway the finance and accessibility in financial instruments.


By the unification of these critical dimensions, this research article provides holistic analysis of legal and financial or economic complexities in utilizing the guarantees for cross-border supply chain finance (CBSCF) providing a pliability and adaptable financial ecosystems amidst a diverse global conditions.
