Ritika Chatterjee, Jindal Global Law School

ABSTRACT

“Isn’t the FUTURE FEMALE?” This paper is aimed at discussing a very important topic related to the mitigation of gender bias in different sectors using Artificial Intelligence. It's relevant because the problem of gender disparities is being acknowledged and addressed globally and nationally. The goal of this paper is to provide a comprehensive analysis of the topic, specifically in India. The paper shall examine the contribution of women in a technologically advancing nation, with a focus on Intellectual Property incentives.

The paper shall commence by understanding the importance of the intersection of the topics, in the Indian context, by focussing on the Sustainable Development Goals (SDGs), as adopted by the United Nations to address issues that are relevant to each member-state. The paper shall continue with analyzing the role of women in present India, which on the one hand, worships female power, but on the other, does not treat women equally to men. The paper shalldiscuss the concept of Women’s Empowerment in India, and how it has affected the various aspects of the nation. The next discussion will be around Artificial Intelligence (AI), and its evolution.

The paper shall then identify some important legal reforms, laws, and regulations that expressly deal with the welfare of women in India, but at the same time, lack the mention of AI and AI tools that would aid in the smooth implementation of these laws. The intention behind linking AI and Women’s Empowerment is crucial because, in the era of technology, itis important to utilize the existing resources to fight the unwanted disparities emerging withinand outside the country, to achieve gender neutrality. It is relevant to mention that AI innovation and creation need IP incentives. There are several reasons for striking a balance between the two. When we talk about women’s empowerment in the Indian context, there are certain ways in which IP incentives will help in the promotion and growth of both fields simultaneously.

After examining three theories in our research, we have come to understand the significance of combining the two issues. This supports our argument for creating new legislation or modifying current laws to address all major concerns related to these topics.
