Right To Have Access To Legal Service In Case Of Marginalized Section: To Kill A Mockingbird

Prashant, BA LLB, Symbiosis Law School, Hyderabad

ABSTRACT

In the novel To Kill a Mockingbird, “Tom Robinson is a black man who works in Link Deas' cotton fields. He is arrested and charged with the rape and assault of Mayella Ewell, even though he was totally innocent.” The novel shows how unfair society is towards the black community. The author through this novel depicts the deep-rooted racism prevalent in modern society. The white community kept teasing Jem and Scout because their father was defending a nigger. Even the law which is meant to protect and give justice to all had been partial towards the white community and hence Tom Robinson was falsely convicted for raping the white woman Mayella Ewell. Many times, even in the civilised societies of the world, innocent blacks are falsely convicted and punished. In this case, Tom was given legal support but ultimately the jury members voted against him without any valid arguments or proof. So the need to get an unbiased legal process by even the marginalised sections of the society has been addressed in this project.
