Right To Be Forgotten: A Journey From Principle To Legal Right In India

ABSTRACT

With the rise of Cyber space we have carved out a new public space altogether. This new public space has emerged as a parallel world to the real world due to our interdependence and interactions on the Cyber space. With the advent of Cyber space we have moved our Human Rights, Political Rights, Economic Rights, Social Rights into the arena of cyber world with a new categorization ‘Digital Rights’. Right To Be Forgotten is an emerging Digital right in the realm of digital space. Due to the inexhaustible and unfading nature of Cyber space, the information acquires a permanent space on the Internet. As ‘Internet never forgets’ so the Humans can also not forget. Hence, Right To Be Forgotten (RTBF) has evolved as a right to resolve the issue of the permanent nature of information on the Internet. In this paper, we will discuss the Concept, origin and development of Right To Be Forgotten from a principle to a legal right in India. This paper will also bring out the Interdependence and contradictions this right has vis-à-vis other Human Rights such as Right To Privacy, Freedom Of Expression etc.
