RG Anand Vs. Delux Films (1978): Analysing Its Relevancy In The Contemporary Era

INTRODUCTION

Every creator is known for his creation and it is his duty to protect his creation from being copied. A creator is known by his creation, the originality defines a creator. Copyright is a type of intellectual property right which authorises the particular product to be original creation of the copyright owner. These legal rights protect all the literary, musical work or dramatic works from being copied. Original work when is duplicated without the creator's consent, it is considered a copyright violation or copyrights infringement giving an inherent right to the original creator to proceed against the infringers and gain back their originality. It is indeed very pertinent to note that the Copyrights Act has not provided distinction between copying and similarity. The landmark judgement given in RG Anand1 case by the honourable supreme court laid down certain guidelines with this regard. This case came to become one of the most influential pronouncements made in the copyright’s history.
