Restorative Justice Model: Is It The Best Criminal Justice Tool?

ABSTRACT

The reformative approach model seeks to bring about a change in the attitude of the offender so as to rehabilitate him as a law-abiding member of society. Punishment is used as a measure to reclaim the offender and not to torture or harassed the offender. ‘Hate the sin not the sinner’ as quoted by Mahatma Gandhi, every individual should be given a chance to repair the harm. The restorative justice could be seen as an emerging model, as both the parties can equally participate in this justice model. It is the model where the individual can restore by repairing the harm caused by him to the victim. Here the victim can clearly define the pain as well as the grievances and the defendant takes the accountability as well as the responsibility which acts as the guilt leading to the further deterrence from the commission of the crime. In this research paper, the researcher tries to understand whether Restorative Justice Model is the Best Criminal Justice Tool?
