Restitution Of Conjugal Rights: An Analysis

ABSTRACT

Conjugal right, i.e., rights created by marriage on the part of husband or wife for the society of the other spouse is one of the basic aspects of marriage. When there is tussle in between the husband and wife the first and foremost thing which get affected are these rights in one or other form. In this paper we look at the different provisions provided in the legal system for restitution of these rights. Initiating with the historical background then to the provision of different restitution of conjugal rights in different laws are briefly taken care of. The constitutional validity along with different rights such as right to privacy, right to equality and different women rights are also there to be considered with the restitution of conjugal right.
