ABSTRACT:


The Critical Need for Enhanced Safety Measures for Labourers in India: A Legal

Imperative


The alarming absence of adequate safety measures for labourers in India necessitates immediate legal and systemic intervention. This issue transcends humanitarian concerns, posing significant legal and ethical challenges with far-reaching consequence.


The Gravity of the Problem:


  • High Injury and Fatality Rates: India witnesses a staggering number of occupational accidents and fatalities annually, often attributed to insufficient safety protocols. A 2021 report by the International Labour Organization (ILO) estimates 40,000 work- related deaths in India per year, highlighting the gravity of the situation.

  • Widespread Non-Compliance: Despite existing legal frameworks like the Factories Act, 1948and theBuilding and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, implementation and enforcement remain weak, leading to rampant non-compliance.
