Relevance Of Fundamental Duties

ABSTRACT


The concept of Rights and the subsequent duty attached to the same is existent in almost every legal system around the globe. The instances of the same can be traced back to the era of Monarchy and the Religious legal systems as-well. Back then, when Customs prevailed as ‘Laws’ governing the society, an element of Morality and Ethics was also present within the citizens residing in that Legal System. The element of ‘Duty’ towards the State is also reflected in the Indian Society in the form of ‘Kartavya’ and ‘Dharma’.


However, due to modernization and development over time, a drastic shift towards emphasising the Legal Rights of Individuals has been seen. Currently, all the legal systems function on the prerequisite which protects, promotes the Fundamental Rights of its citizens. This extreme polarization towards the Rights has overshadowed the significance and essence of performance of the Duties which are on the part of the citizens. Somewhere, the concept of Duties is now like the Lost City of Atlantis. Hereby, this research paper aspires to explore the relevance of fundamental duties by the virtue of examining the constitutional mandate, statutes & leading case laws of the same.
